ABOUT STATE BAR ASSOCIATION OF NORTH DAKOTA HIGH SCHOOL MOCK TRIAL

The SBAND HSMT is a hands-on activity for high school students. Working with attorney and teacher coaches, participants prepare a hypothetical legal case and learn about our legal system while they develop important critical thinking, research, and presentation skills.

During competitions, mock trial teams present their cases in front of a panel of judges and jury members. From opening statements through closing arguments, each team has its own attorneys and witnesses and must be prepared to try both sides of the case.

For more mock trial information and resources visit our website.

MOCK TRIAL ROLES

Attorneys: Attorneys work in teams of 2 or 3 to present the case for their side. Duties include opening statements, direct and cross examination, and closing arguments.

Witnesses: Mock Trial cases have 3 witnesses for each side. Each witness takes the stand and answers direct and cross examination questions from team attorneys.

Timekeepers: Timekeepers for both teams work together to ensure accurate and fair time has been kept for both sides.

MOCK TRIAL QUICK FACTS

December 8: Baby New Year is on its way .. Let's talk about ethics!

Accidentally Giving Birth…to a brand new baby client

Approved for 1.0 CLE Ethics Credit (ND)

MN Credit will be applied for

Picture this: a friendly chat, a helpful tip, or a casual “I’ll take a look” turns into an unexpected delivery—a full-fledged lawyer-client relationship!  In this program, the CLE Performer, Stuart Teicher will uncover the sneaky ways these bonds form without you even noticing. He will explore real-life traps and arm you with the know-how to spot, manage, or dodge these unintended commitments while staying true to the Rules of Professional Conduct.

Learning objectives include:

  • Recognizing the Moment of Conception: Understand how Rule 1.18 (Duties to Prospective Clients) applies to casual conversations or initial consultations
  • Advice as the Spark of Life: Examine how offering legal advice—whether in a quick email, a barstool chat, or a social media reply—can ignite a lawyer-client relationship under Rule 2.1 (Advisor)
  • Communication: Delivering Clarity: Dive into Rule 1.4 (Communication) to see how failing to explicitly disclaim a client relationship when giving advice can birth unwanted duties

College Mascots and Professionalism!

A knight rides across midfield in full armor. A storm cloud struts the sideline. A horse rears at the fifty-yard line like it owns the place. Then there's the giant vegetable, running the same routine with the same commitment. Professional legal educator Stuart Teicher, Esq. (known as The CLE Performer) reads these mascots as character studies: honor, force, loyalty, and the discipline to stay in character even when the costume is ridiculous. Lawyers build reputation the same way, one trait at a time, dignified or not.

Learning objectives include:

·         Recognizing how a knight mascot's code of honor reflects the aspirational ideal of treating opposing counsel with fairness and civility

·         Connecting a storm mascot's consistent, controlled power to the aspirational ideal of considering how personal conduct affects the image of the justice system

·         Applying the steady loyalty behind a workhorse mascot to the aspirational ideal of professional interdependence for the benefit of clients

·         Identifying the discipline behind an undignified mascot's full commitment to its role, and tying that discipline to the aspirational ideal of maintaining a high level of competence regardless of a case's profile
