NORA Establishes New Industry Term & Position Paper for “Vacuum Tower Asphalt Extender”; Specification being Developed

NORA members utilizing distillation towers to process used oil generally produce a product traditionally called asphalt flux as well as vacuum tower bottoms, re-refined engine oil bottoms and a variety of other terms. The NORA Board of Directors has approved a more modern and descriptive term for this valuable product: Vacuum Tower Asphalt Extender (VTAE). It has two main applications: road paving and roofing materials. The term VTAE was developed by a group appointed by the NORA Board of Directors to address the growing threat to this material. Several states have, or are considering, prohibiting the use of VTAE as an ingredient in asphalt pavement. Following two months of research and close coordination with industry groups such as the Asphalt Institute, the group has developed a position paper (that references primary research by the Heritage Research Group) that calls for a reversal to the bans that some states have placed on VTAE. Click here to view NORA’s Position Paper. NORA believes any prohibition of the use of VTAE is unwarranted and detrimental to high quality pavement construction. NORA will be working with its members in targeted states to advocate for the use of VTAE. In the next month, NORA will be developing a specification for VTAE. This issue will be addressed in detail at the 2014 NORA Conference.




PCB/TSCA Update

On Thursday, September 4, 2014, NORA met with EPA representatives related to the association’s PCB/TSCA Reform proposal. If adopted, NORA’s proposal would allow members who follow the association’s Best Management Practices to handle unintentionally diluted PCB contaminated used oil in its as found condition. NORA’s Executive Director Scott D. Parker stated, “The association’s proposal would dramatically reduce the cost and liability associated with a PCB hit. The group of people from EPA working on this are extremely interested. They are bound by rules and laws but they recognize the issue and are trying to work with us. We fully expect positive results.”

New York Court Dismisses All Remaining Counts Against Heating Oil Marketer

The highly publicized New York case against Castle Oil Corporation, a member of NORA, has been dismissed. In an opinion and order filed on September 11, 2014 the judge dismissed all remaining counts. These counts alleged that Castle Oil breached its express and implied warranties and breached the contract when it sold heating oil containing on-specification used oil fuel. On October 21, 2013 the court dismissed the counts relating to negligent misrepresentation, unjust enrichment, and violations of federal and New York consumer protection laws. Last year, NORA submitted an amicus brief to the court, pointing out that selling used oil fuel that meets all regulatory requirements is a lawful and legitimate business practice in the energy market. In a parallel case, Mid Island LP. v. Hess Corporation, the same court on the same day dismissed all breach of warranties and breach of contract claims against Hess Corporation. The court had previously dismissed the counts alleging negligence, unjust enrichment and violation of federal and state consumer protection laws.




NORA's Fight For PCB/TSCA Reform Featured in Lubes'n'Greases Magazine

The September 2014 issue of Lubes'n'Greases Magazine featured an article on NORA's Fight to Reform the Toxic Substances Control Act (TSCA) titled "Toxic Oils, Lethal Rules". Lubes'n'Greases, a major industry publication for the global lubricants and grease industry, reaches over 16,700 subscribers each month. In this article, NORA Executive Director Scott Parker and NORA General Counsel Chris Harris are interviewed regarding the association's proposal to reform PCB/TSCA in order to protect members who are responsible participants within the industry.

NORA Member Sequoia Energy & Environment Expands Technology to Argentina

Sequoia’s hydrotreating technology is now operational in Argentina. This small hydrotreater produces 2.5 m3/hour (about 700 US gallon/hour) of Group 2 base oil from a dark distillate produced from an old furnace reboiler used for oil distillation.
